‘Around the World in 12 Days – December 2007 Term and Conditions’

HOW TO ENTER

To be eligible to enter, individuals must agree to be registered to JOBX. To enter, individuals must, during the promotional period of 10/12/07 – 21/12/07 either:

a) visit jobx.com.au, follow the prompts to the competition entry page, input the requested details and submit the fully completed entry form; or

b) click through to www.50things.com.au via an online advertising portal, follow the prompts to the competition entry page, input the requested details and submit the fully completed entry form.

In order to gain additional entries, entrants can refer friends via email by clicking on the ‘refer a friend’ link on the website and inserting the requested details of their friend, including their email address in order to complete their entry. Individuals may refer an unlimited number of friends provided each friend is an Australian resident aged 18 years or over. The entrant will receive one additional entry per referred friend.

Entrants will receive no additional entry if a referred friend is already a member or if the email address supplied is not verifiable. Each friend can only be referred once.

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years or over except for residents in the ACT. Employees (and their immediate families) of the Promoter (“JOBX Limited”) and agencies associated with this promotion are ineligible to enter.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Incomplete, indecipherable or illegible entries will be deemed invalid.

5. Multiple entries permitted, subject to the following: (a) only one initial entry permitted per person; (b) one additional entry will be awarded for each additional successfully referred friend; and (c) each entry being submitted separately and in accordance with entry requirements.

6. By submitting a friend’s details via ‘submit’ on the web form and therefore being awarded an additional entry to the competition, the submitter agrees to abide by the terms and conditions.

7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

8. Promotion commences on 10 December 2007.  Entries close 5.00pm AEDST on 21/12/07. An electronic draw will take place at JOBX Limited, Suite 5, 26-32 Pirrama Road Pyrmont NSW 2009 on 08/01/2008 at 9.00am AEDST. Winners for both the daily prize and main prize will be notified by mail and winners’ names will be published in The Australian on 09/01/2008.The Promoter’s decision is final and no correspondence will be entered into.

9. The first valid entry drawn will win travel to the value of $10,000. Total prize value is up to AU$32,000.00 The winner agrees to receive these prizes as their ‘Trip of a Lifetime’. Additional travel insurance all other ancillary costs are the responsibility of the winner. The winner must contact the prize provider(s) to arrange delivery of their prize. If the winner is, for some reason unable to arrange delivery themselves, the Promoter will contact the winner and organise for the prize(s) to be delivered to the winner, to be determined by the Promoter in its absolute discretion.

10. Daily prize entries commence on 10/12/2007 with the final daily prize drawn on 21/12/2007 (total of 12 daily prize draws). Entries received before 5pm AEDST on 10/12/2007 will be entered in the first daily prize draw. All entries received between that time and date until 5pm AEDST on 21/12/2007 will be entered into the next available daily prize draw.

11. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

12. Total prize pool value is up to $32,000.00 Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

13. A draw for any unclaimed prizes may take place on 13/04/2008 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian on 20/04/2008

14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

15. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

17. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

This Website Terms of Use Statement applies to websites owned and operated by or on behalf of the JOBX Limited ACN 120 877 267 (JOBX) under the domain name www.50things.com.au.  Your access to and use of the 50 Things To Do Before You Retire is subject to these terms of use.  By using the 50 Things To Do Before You Retire Website you agree to be legally bound by the following website terms of use, which shall take effect immediately on your first use.

1. Users will not post any information that could reasonably be considered to be defamatory or offensive including but not limited to comments that are, lewd, disparaging of an individual or group, of a sexual nature or of a harassing nature.

2. JOBX does not take responsibility for any of the following:

  • any interruption to or inability to access any list or add to any message board or forum;
  • any inability to log-on or access your online account;
  • any matter, circumstance or thing beyond JOBX control.
3. You warrant that in accessing or visiting any lists, message boards, forms or any user account you will not introduce any virus or other malicious harmful or destructive code.

4.  You are not permitted to link any website to 50 Things Before you Retire prior to receiving written permission.

5. Nothing in the Terms of Use will exclude, restrict or modify any rights or remedies which you may have under any applicable Commonwealth, State or Territory legislation which under such legislation cannot be excluded, restricted or modified by agreement.

These Terms are governed by the laws of the State of New South Wales. JOBX Limited may amend, revise or replace the Terms from time to time.
